Now that it is clear that they will not turn into instant millionaires (believe me, most of them already are), they have suddenly become the EB community's stalwart best friend and are even filing a lawsuit for us because the thought of returning the 2000$ fees for filing 485 is killing them. They may even shed a tear at our sorry plight.

Current Status: H1 (visa stamp expires Sept 2011)
Citizen-India
Current: Company A (Has filed for h1 extention on May 1 under normal processing)
Future: Company B (Has filed for Transfer under Premium Processing as of May 6)

Currently employed with A. Company B lawyer has filed a transfer on May 6 Premium Process.(I believe current status is LCA is under process).

I plan to resign on May 21 with A and travel abroad to Dubai On May 22. Will be back on June3 to usa
>Can i travel abroad even if my tranfer is under process
>When i enter, what documents do I need to show at POE?
> Can i enter with Company A visa stamp
>Any issues if current employer informs USCIS about my resignation?

Its a emergency travel i cannot avoid. What needs to be done to make my trip

As per latest Faqs from USCIS interim EAD is possible. See below;

Q) I filed my Form I-765 more than 90 days ago and I have not received a decision, who should I contact?

A) If you have not received a decision within 90 days of the USCIS receipt date and you have properly filed your EAD application, you may apply to obtain an interim EAD by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization.

HI!! I'm Aj ( more like Ahmet Jorayev). I was a student at the Georgia Military College. Unfortunately, due to lack of my personal funds, i lost my position of a student at GMC. Since January of this year i was not attending school because of exclusion. College informed of returning in Spring 2010 however they denied it later on. Currently I'm in deep depression because of losing my Academic and Immigration Status!!
IN order to reinstate I-20 visa i had to attend college. Sarcastic thing about this i had only 6month left to graduate.
Any advises or stories you can share please, help out!!
They have our future in their hands and instead of supporting,they disgrace us!!

Hi,

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

What are the best options for H1B refiling case

in case if it is denied, will it super impose the original H1B approval ?

is it good idea to cancel/revoke pending H1B refiling case ?

Can somebody help me on this one:

Regarding the receipt notice of I-485: which is the difference between the receipt date, receipt number and receipt notice.....from my understanding....the receipt date is when your I-485 application hits Uscis and the receipt notice is when the Uscis is really opening your package and looking at it?

Is it safe to travel( with valid H1b) knowing that your file hits the Uscis...or you have to wait for the receipt notice( now with so many filers for July, is it true that Uscis will send the receipt notice very late, maybe months, I mean later than the June filers.)?

Is it safe to travel after you file for I-485 and before getting the receipt notice....hoping that the receipt will come after you returned to U.S?

Thank you so much...I'm so confused about this receipt notice, I didn' find any law regarding this, that you can not travel witout receipt notice.
