Looks like your I140s denied for ability to pay (based on the RFEs). But also you were paid more than the prevailing wages! Per my exp, even if company makes loss, but you were getting paid, it shouldn't be a reason for denial.

The company is very healthy financially and has around 100 employees on payroll. They have successfully processed many GCs for the existing employees in the last 3 years. The irony is one of my friends that filed with me on the same advertisement and profile got his GC 18 months ago!!

Yep! There is a relation between 485 and H1-B extension after 6 years limit.If your AOS date is current, You only get one year increment else three years extension upon I-140 approval.

Please contact an Attorney for clarification.

I dont think the three year extension has anything to do with 485. If your 140 is approved you get 3 years if there is no visa number is available for you. No need to be U.

Hello all,

I am not able to get my passport renewed. Indian consulate in Houston said that it will take atleast 4 weeks to get a passport.

Pl help. Can I go ahead and apply for my 485?

Also, would you know anything about copies of affidavits?

Pl reply. I am in serious bind.

I think its your LC job requirements which governs EB2/EB3. For EB2 classification on your I-140, your job must require 'Masters' or 'Bachelors+5Yrs Experience' on Labor Certification.

My Job ad says: Sr Business analyst wanted ... with MS/MBA or foreign equivalent with 5 yrs exp.

I have
BSc in physics - 3 yr India degree
PG diploma in Instrumentation - 1 Yr India PG diploma
PG dip in marketing mgmt - 1 Yr India PG dip (E learning)
PG dip in buiness admin - 1 Yr India PG dip (E learning)
MBA - 3 Yr India PG degree (E learning)

6 yrs in healthcare, 2 yrs in sales, 5 yrs as Business analyst with Indian s/w vendor. 13 yrs in total.

Does my job ad allow me to qualify for EB2? Will I have any issues at my I-140 stage? Pls share your thoughts

Check page number 9. It speaks about Interim EAD, and this document expires on 08/31/08. If they have stopped issuing Interim EADs how come it says the opposite on this document. Just wondering:confused:

Try to file for a change of status from H-1 to H-4, include the hospital records and letter from the employer that your wife is on maternity leave, see what happens. If that does not work then you can think of leaving for a visa, you will not be barred for 10 years as you have not accrued unlawful presence, this is only accrued if your I-94 expires or the USCIS determines that you are out of status. However, going outside the country is risky as you may not get a visa and may get stuck outside the country. I would try to do the COS first.

Hi all,

In her passport, my wife's name appears as follows :

Given name = <blank>
Surname = <First name> <Last Name>

Now visa stamping has this :

Given Name = FNU
Surname = <First name> <Last Name>

We are filing I-485 this week and in all the forms we were thinking of giving :

Given Name = <First name>
Surname = <Last Name>

At the same time initiating a Name Split in the passport. Is it advisable to have name split in passport while I-485 is in process?.

There is actually no "name change" per se. Just splitting it and putting it under the correct first and last names. If we file it using FNU, then all her records like DL, SSN, EAD, AP & then GC all will be starting with FNU, which is what we want to avoid.

The ideal way would've been to split the name in passport first and then file it, but we are afraid we could get stuck with retrogression again, if the process gets delayed! :confused:

Please advise !

The Vermont Service Center (VSC) has advised that they have instituted a new procedure for issuing interim Employment Authorization Documents (EADs). These are appropriate in situations where the EAD request has been pending for at least 90 days. The expected termination of interim EADs at local USCIS offices was reported in our June 30, 2006 MurthyBulletin article, June 2006 Conference Update: Interim EADs to End, available on MurthyDotCom.

The new procedure requires that an individual go to the local USCIS office to make the interim EAD request. The local office then will contact the VSC. The VSC will review the file and try to adjudicate the initial EAD application and avoid the need for an interim EAD. If they cannot complete the initial application, however, they can issue an interim EAD.

The interim EAD will not be issued if there are "national security issues." Therefore, if the case is held up due to security concerns, there may be instances where the interim EAD is not given. Whether or not it is issued depends upon the severity of the security matter.

MurthyDotCom and MurthyBulletin readers who will be renewing their EADs should not wait until they are close to their expiration dates to request new ones.
